NASCAR Settlement Talks Stall as Race Teams Challenge Court Motion
23XI Racing and Front Row Motorsports have responded critically to NASCAR’s recent request for a settlement conference, describing it as an attempt to influence public perception rather than a genuine effort to resolve ongoing disputes. In a joint statement filed Monday, the teams indicated that there has been no progress toward resolution, despite previous mediation efforts led by experienced arbitrator Jeffrey A. Mishkin on August 5, 2025.
NASCAR’s motion seeks the appointment of a magistrate judge to oversee the settlement conference. However, 23XI Racing and Front Row Motorsports argue that continuity with Mishkin, who is already well-acquainted with the case, would yield better results. “Mr. Mishkin has invested a great deal of time learning this case,” the response noted, highlighting his extensive engagement with the parties involved.
The teams have expressed frustration over NASCAR’s lack of response to their settlement negotiation requests, suggesting that the governing body is dissatisfied with the current mediation process and seeking a “second opinion.” They asserted that with trial set to begin on December 1, changing mediators would likely hinder rather than facilitate resolution efforts.
Additionally, a hearing regarding a motion for summary judgment that the teams have filed is scheduled for October 21. As this case progresses, both teams remain open to settlement discussions, emphasizing their willingness to engage with NASCAR on this matter.
