Drivers Advisory Council Submits Amicus Brief in NASCAR Antitrust Case

In a pivotal move, the Drivers Advisory Council (DAC) filed an amicus brief in federal court on Tuesday, outlining concerns regarding the ongoing antitrust lawsuit against NASCAR. This entry comes amid a legal dispute which may significantly affect drivers’ rights and interests within the sport.

The joint lawsuit, initiated by 23XI Racing and Front Row Motorsports on October 2, 2024, targets NASCAR’s charter agreement, with the plaintiffs being the only two of 15 charter holders that declined to sign the 2025 charter agreement. The DAC emphasizes that “any resolution in this case may materially impact” the rights of drivers, creating a pressing need for their perspectives to be considered.

Formed in 2022, the DAC aims to unify drivers’ voices and negotiate essential initiatives, including the recently implemented Driver Ambassador Program, which incentivizes drivers for promoting NASCAR. The program’s structure—which is currently under legal scrutiny—was articulated in the brief as crucial to the sport’s future.

Upcoming legal proceedings include a court-mandated settlement conference scheduled for Tuesday and a summary judgment hearing on Thursday, with a trial date set for December 1. The DAC asserts that the absence of drivers’ input in discussions about the sport’s future undermines the negotiations’ effectiveness.

Key objectives articulated by the drivers through the DAC include: protecting the long-term interests of current and future drivers, ensuring an independent voice for drivers in significant decisions, and prioritizing fan experience through collaborative action among stakeholders.

The DAC’s brief underscores the drivers’ integral role in NASCAR’s popularity, stating, “without the drivers and the fans, there is no future for NASCAR.” As the sport navigates this critical juncture, the drivers’ collective voice aims to safeguard their interests and enhance the overall experience for fans.
