Hendrick and Penske Ordered to Testify in NASCAR Antitrust Case
In a significant development, U.S. District Judge Kenneth Bell has ordered NASCAR team owners Rick Hendrick and Roger Penske to be deposed as part of the ongoing antitrust lawsuit against NASCAR. This ruling, issued on Tuesday, denies both owners’ requests to avoid deposition or impose limitations on their testimony.
Judge Bell emphasized the court’s commitment to a fair trial, stating, “No company or individual will be accorded special treatment… Plaintiffs have the right to promptly depose them before trial and cross-examine them at trial.” The trial is slated for December 1, 2024, as part of a lawsuit initiated by 23XI Racing and Front Row Motorsports.
While both owners previously supported NASCAR by signing declarations in early October, they now seek minimal involvement, preferring that any deposition concentrate solely on the charter system and the Next Gen race car. Nonetheless, NASCAR has included them on its witness list, further complicating their request to limit their participation in the proceedings.
