NASCAR Secures Judicial Settlement Conference in Antitrust Dispute
U.S. District Court Judge Kenneth Bell has approved NASCAR’s request for a judicial settlement conference regarding the ongoing antitrust lawsuit involving 23XI Racing and Front Row Motorsports. This decision follows NASCAR’s recent motion seeking a new mediator; however, Judge Bell will oversee the proceedings with the previously designated mediator, Jeffrey A. Mishkin, who has familiarity with the case.
Both 23XI Racing and Front Row Motorsports expressed a preference for Mishkin, citing concerns that introducing a new mediator would prolong the process unnecessarily. Jeffrey Kessler, lead counsel for the plaintiffs, remarked, “We welcome Judge Bell’s decision to bring all parties together to engage in meaningful resolution… Our objective has been unwavering: to secure lasting stability and growth for every team, their employees, and the sport.”
The settlement conference is scheduled for the morning of October 21, coinciding with a previously planned summary judgment hearing, which has now been rescheduled to October 23. This strategic adjustment reflects NASCAR’s intention to foster dialogue rather than proceed immediately to litigation.
