Legal Dispute Erupts Between Rick Ware Racing and Legacy Motor Club Over Charter Sale

Overview
A significant legal clash has erupted between Rick Ware Racing (RWR) and Legacy Motor Club concerning the contested sale of a charter. RWR has countered a lawsuit initiated by Legacy Motor Club, which claims RWR reneged on the sale agreement.

Background
The core of the dispute arises from a sale agreement involving either Charter No. 27 or Charter No. 36, both owned by RWR. Legacy Motor Club, which recently welcomed Jimmie Johnson as its majority owner, alleges that RWR did not honor its commitment to sell. The initial lawsuit was filed in April 2023 after RWR reportedly backed out of the sale.

Key Details of the Countersuit
The countersuit, filed on June 4, 2023, asserts that the sale agreement specified Charter No. 36 for a total of $45 million. The document reveals an “actual and justiciable controversy” over the identified charter and the sale conditions.

It was further stated:

  • Legacy’s claim of purchasing Charter No. 27 constitutes a breach of the original agreement.
  • RWR maintains that errors in the agreement, including the sale year being mistakenly listed as 2025 instead of 2026, do not invalidate its contractual obligations.

RWR’s Position
RWR alleges that discussions during the Las Vegas race weekend indicated that Legacy intended to acquire Charter No. 27 despite prior agreements concerning Charter No. 36. RWR asserts that selling Charter No. 27 would jeopardize its operations.

Ware’s legal team has made multiple attempts to return a non-refundable deposit of $750,000 to Legacy, which were reportedly rejected.

Relief Sought
In its countersuit, RWR seeks:

  • Dismissal of Legacy’s claims with prejudice.
  • A declaration invalidating the original agreement.
  • Recovery of attorney’s fees and related costs.

Conclusion
As this legal battle unfolds, the outcome may have significant implications for the operational dynamics of both teams in the competitive NASCAR landscape. The courtroom will now determine the legitimacy of each party’s claims and the future of their agreements regarding the charters.
