Legal Dispute Escalates Between Legacy Motor Club and Rick Ware Racing

Earlier this year, Legacy Motor Club (LMC) initiated legal action against Rick Ware Racing (RWR), alleging an attempt by RWR to unlawfully retract a charter sale agreement. The lawsuit revolves around a Charter Purchase Agreement for a RWR-owned charter intended for the Jimmie Johnson-led LMC.
Both teams currently maintain two charters each, with RWR leasing one to RFK Racing for the No. 60 entry. Should the charter acquisition proceed, LMC plans to expand into a three-car operation by 2026.
In response to LMC’s suit, RWR has filed a countersuit. RWR claims that the original charter sale was intended for the 2027 season and asserts that it cannot afford to sell Charter No. 27 without jeopardizing its business operations. “If forced to sell this charter…we would go out of business,” RWR stated, emphasizing it never agreed to an early transaction.
The contention centers on Charter No. 27, currently utilized by RFK Racing, and Charter No. 36, which Cody Ware drives in the No. 51. RWR argues that the charter in question was misidentified in LMC’s legal filings, potentially invalidating the lawsuit.
Additionally, RWR asserts it attempted to return a $750,000 deposit to LMC, which was part of a proposed $45 million deal—the most expensive charter sale in NASCAR history. LMC reportedly did not accept the refund, further complicating the situation.
This ongoing litigation raises critical questions about charter rights and the implications for team operations within NASCAR.
